The journey between your home and your workplace remains private use. A mission given by an employer, a self-employed round of client visits, paid transport of passengers or goods are not, and it is that gap, not the mileage, that your insurer will examine after a claim. Declare the use you really make of the car, not the one that gives the lowest premium.
Is the commute private use?
Yes, in principle. A Belgian broker's FAQ says so plainly: going to work and coming back remains private use. AXA's Confort Auto general conditions, in their 2017 edition, make it the reference point: the « passage d'un usage privé et chemin du travail du véhicule à un usage professionnel » (move from private and commuting use to business use) serves there as the example of a change to report.
That is the reassuring half of the story.
Four uses that the word « private » does not cover
The brochure of Assuralia, the Belgian insurers' federation, sets the principle in one line: private use costs less, business use costs more. What remains is where the line falls and what each contract says about it. I read four Belgian documents; the table sorts what they allow us to conclude and what they leave open.
| Actual use | Classification in principle | What the documents say | What to do |
|---|---|---|---|
| Commute, errands, weekends | Private | Belgian broker FAQ; AXA 2017 example | Nothing |
| Employer's mission, sales round, client visits, self-employed work | Business | Belgian broker FAQ: teachers in several schools, sales reps, outside service staff | Have the use changed by written endorsement |
| Carrying people or goods for payment | Excluded or to be named | AXA 2017: exclusion of « transport de personnes ou de choses contre rémunération » (carrying people or goods for payment); Ethias, art. 43 §2: damage to goods carried « à titre professionnel et onéreux » (professionally and for payment) excluded | Ask for written cover |
| Car rented out to third parties | Often excluded under omnium | AXA and Yuzzu information document (January 2026): damage to a vehicle « donné en location » (rented out) excluded under omnium; AXA 2017: exclusion « sauf leasing et renting » (except leasing and renting) | Do not rent it out without written agreement |
| Carpooling between private individuals | Not settled | None of the three documents names it | Write to the insurer |
Two remarks on this table. The AXA general conditions date from 2017: they show a practice, not the contract you would sign today. And the paid-transport line is less a classification of use than an exclusion: the contract may simply not pay, which is far more serious than a surcharge.
How many business kilometres before you need to change policy?
Neither the law nor Assuralia sets a threshold, and that is the trap. The broker FAQ quoted above says that, for most insurers, occasional business use below 2,000 km a year lets you stay on third-party liability (RC) cover for strictly private use. It also states that, for an employee, it is in principle the employer who bears the surcharge for regular business use.
Those two markers come from a broker, not from a legal text. Your contract may set 1,500 km, 3,000 km, or say nothing.
An order of magnitude to measure the gap. A sales rep visiting clients over 40 km per working day, 220 days a year, drives 8,800 business kilometres, 4.4 times that 2,000 km threshold. They are no longer in the tolerance zone: they are in regular use. The calculation is mine, and the 40 km a day assumption may be too high or too low for you; redo it with your own records.
Another wording of the same idea: the criterion is not distance alone, it is the nature of the journey and its regularity. A teacher who gives lessons in two schools drives few kilometres, but each one belongs to the job and not to the way there; a rep who drives a lot but only on Thursdays raises a threshold problem instead. Both cases are settled the same way, in writing, before an assessor asks the question for you.
Use changes during the contract: one month to adjust
Use is not declared once and for all. It moves with the job, the client, the mission, and both the Insurance Act of 4 April 2014 and the contracts require you to report whatever increases the risk.
Ethias's general conditions, whose edition is not dated, require any « aggravation sensible et durable du risque » (significant and lasting increase in risk) to be declared in article 6. If the insurer would only have accepted the risk on other terms, it must propose a contract change within the month; if you refuse, it may terminate within fifteen days. The text does not name use among its examples, but a move from private to business use is typically what an increase in risk covers. At AXA (2017 edition), the contract is more direct: « En cas d'omission ou d'inexactitude, nous réduirons ou refuserons notre intervention » (in case of omission or inaccuracy, we will reduce or refuse our payment).
Two wordings, two possible sanctions, and neither leaves you in control.
What does a mistake about use cost after an accident?
It depends on two things: intent, and the guarantee that applies. Here is a worked case, with fictional amounts.
An employee declares strictly private use, then the employer assigns a weekly round of client visits. One day in February they cause an accident during that round, and the liability insurer pays 14,500 euros to the victim, because under liability cover the victim is compensated in every case.
The insurer then turns against the policyholder, and that is where everything is decided.
- Non-intentional mistake: recourse is capped at 250 euros, according to the Assuralia brochure and article 45 3° of Ethias's general conditions. The policyholder pays 250 euros out of 14,500.
- Intentional omission: recourse covers the full amount, 14,500 euros, and the insurer may also ask for the contract to be declared void.
- Damage to their own car under omnium: the payout may be reduced in proportion to the premium a correct use would have cost, a mechanism detailed in our article on false declaration.
The January 2026 AXA and Yuzzu information document sums it up in one sentence: total or partial reimbursement of the sums paid may be demanded in certain cases. The general conditions list those cases.
Carpooling, delivery, renting out: the silence of the texts
Here is the nuance. On carpooling, the three Belgian documents I read say nothing. The Assuralia brochure does not mention it, Ethias's conditions do not define it, and the AXA and Yuzzu document does not mention it either. A silence is neither a permission nor a prohibition.
My cautious reading: sharing fuel costs between colleagues does not look like paid transport, but « does not look like » is not a guarantee. As soon as the trip earns more than it costs, or as soon as a delivery platform pays you per trip, you leave the grey area and enter the exclusion for transport against payment, in the contracts that contain it.
One more detail, often forgotten: article 47 §1 3° of Ethias provides for recourse when the number of passengers exceeds the number authorised. Carpooling with five people in a five-seat car is fine. With six, it is not.
Declaring your real use: how to proceed
Ten minutes are enough to know where you stand.
- Open your particular conditions and note the use written there, private or business, and any annual mileage mention.
- Look for the definition of private use in the general conditions: does the journey to work appear there, and in what form?
- Note the exclusions containing the words « rémunération » (payment), « location » (renting out), « onéreux » (for payment) or « professionnel » (business).
- Count your business kilometres over twelve months, from a logbook or an app, not from memory.
- Write to your broker or insurer to ask for an endorsement, and keep the reply. An intermediary has a duty of advice; this is the time to use it.
If your car is also driven by another member of the household, check in passing who is declared as a driver, and if you lend it out, our article on lending your car completes the picture. To read a contract without losing an evening, the particular conditions give the method. A use declared too low can also feed a forfeiture of cover where the contract provides for it. And if your annual mileage is capped, see the mileage declaration.

To line these points up from one contract to another, the comparison tool puts the guarantees side by side, the ranking of the best car insurers sets out what each company covers and refuses, and the quiz frames your driver profile in two minutes. If the claim has already happened, the route is set out in the article on reporting a claim.
The sources are public: the Assuralia car insurance brochure, the Ethias car general conditions (consulted on 15 October 2026, no edition date) and the Yuzzu information document for AXA Belgium. The legal framework is the Insurance Act of 4 April 2014. Where a disagreement over the use retained persists, the Insurance Ombudsman, the free Belgian complaints service for insurance customers, examines complaints, and the FSMA, the Belgian financial services and markets authority, supervises the conduct rules of insurers and intermediaries.
