There is no single deadline, there are several, and they are read in the contract. Belgian law refers to the deadline your insurer wrote down, the standard for liability is eight days, and theft or vandalism sometimes require a police complaint within 24 hours. Better to know before you scratch your door than the day after.
The steps after the accident, accident report form included, are described in the article on reporting a claim. Here, we read the deadlines.
Why does the law give no figure?
Because it lets the contract decide. Under Articles 74 and 76 of the Insurance Act of 4 April 2014 (text in French), the insured reports the claim as soon as possible and in any case within the deadline set by the contract. A delay lets the insurer reduce its payout by the harm it can prove. A full refusal requires fraudulent intent.
So the figure is not in the law. It is in your general conditions, and it varies from one company to the next.
Eight days or eight working days: what is the difference?
The calendar. Belfius's public liability conditions require a written report "immediately and at the latest within eight days of its occurrence" (Article 32 §1). Beobank's car insurance information document speaks of eight working days. An accident on a Friday gives a deadline the following Friday in the first case, and the Tuesday of the week after in the second.
This is not a detail. Count calendar days until you have read the definition in your own contract.
Theft, vandalism, glass: deadlines shorter than eight days
Covers that depend on a police investigation or on fragile evidence have their own clocks. The same Beobank document mentions 24 hours to file a complaint after a theft. At AG Insurance, the Top Omnium sheet found in June 2026 waives the Flexi excess if vandalism is reported to the police within 24 hours. A late complaint then does not cost the cover, it costs the waived excess.
Vandalism, theft of belongings and glass breakage each have their own article. Just remember that the deadline sits in the chapter of the cover, not in the general part of the contract.
Which other deadlines hide after the report?
Belfius's liability conditions contain two that go unnoticed. Information and documents requested by the insurer must be passed on "without delay", and summonses or court documents served on the insured must be passed on "within 48 hours" (Article 32 §3). Do not sign, admit or pay anything without the insurer's written agreement either: Article 33 makes such acts unenforceable against the company.
Forty-eight hours to forward a bailiff's letter is shorter than most people imagine.
Does a late report lose me the cover?
No, not by itself. Article 46 4° of the same conditions only gives the insurer a claim against the insured if it proves it suffered harm because the act was omitted within the deadline. And the deadline cannot be invoked if the report was made as quickly as could reasonably be done.
A worked example, with invented figures. Your car is damaged, the body shop quote reaches €2,400, and you have it repaired before reporting, three weeks after the event. The insurer has nothing left to inspect. If it shows that a €600 item would have been disputed, it deducts €600 from the payout and you receive €1,800. Without that proof, no reduction exists.
Forfeiture of cover is a different, heavier mechanism, and it requires a clear clause.
How do you find the deadlines in your own policy?
Open your general conditions as a PDF and run four searches. Ten minutes is enough, and reading the specific conditions completes the exercise.
- Search "jours" (days): note every reporting deadline and check whether it means working days or calendar days.
- Search "heures" (hours): spot the 24 or 48-hour deadlines, which mostly concern theft, vandalism and court documents.
- Search "plainte" (complaint): note to whom, within what time and for which covers.
- Search "sans délai" and "immédiatement" (without delay, immediately): these words sometimes replace a number and are the ones people overlook.
Copy the results into a note on your phone, with the policy number.
Deadline passed or nearly: what to do case by case?
| Situation | Deadline to look for | Reflex |
|---|---|---|
| Accident with a third party | Eight days in liability (found), working days or not | Report in writing, attach the accident report |
| Theft of the vehicle | Complaint often within 24 hours | Police first, insurer next, same day |
| Vandalism, deliberate scratch | 24 hours at some insurers for the excess | Quick complaint, dated photos |
| Broken glass or headlight lens | Glass chapter of the cover | Report before any repair |
| Summons or bailiff letter | 48 hours in one contract found | Forward the day you receive it |
| Damage discovered late | "As fast as reasonably possible" | Report on discovery, prove the date |

To compare these clauses from one contract to another, the comparison tool lines up the covers, the ranking of the best car insurers details what each company covers and refuses, and the quiz frames the level of cover you need. Legal protection cover helps if the dispute concerns a refusal linked to the delay.
If you dispute a reduced payout, the Insurance Ombudsman, Belgium's free out-of-court complaints service, examines complaints at no cost, and the FSMA, the financial services regulator, supervises the conduct of insurers and intermediaries. The documents cited are public (in French): Belfius car general conditions and the Beobank car insurance information document.
