Legal protection car insurance: three Belgian policies read

Intervention threshold, cover limit, third-party insolvency, exclusions, legal costs award: three Belgian legal protection policies for cars, read line by line before you sign.

Car legal protection pays, up to a cover limit, the lawyer's, expert's and court costs of a dispute involving your car. It is optional in Belgium and carries the same name at every insurer. The figures behind it, however, change completely from one policy to the next.

I checked this against three public documents, read in October 2026. Here is what they say, clause by clause.

Three policies, three ways of saying "covered"

I picked three products a Belgian driver can actually come across when taking out cover. AG Insurance's legal protection option, sold through BNP Paribas Fortis and managed by a specialist entity, Providis. The legal protection option of Belfius Direct Assurances' pay-per-kilometre policy, as described in its October 2024 information sheet. And, for comparison, Ethias' Aide Juridique, a household legal protection policy that many families assume is enough for the car.

The table only shows what these documents state in black and white. A cell without a figure means the public sheet does not specify it, not that no limit exists.

Three products, three logics. The rest of this article explains why the bottom rows weigh more than the top one.

Four blocks, almost everywhere. Civil recovery, when you claim compensation for your loss from the person at fault and their insurer. Criminal defence, when you are prosecuted for an offence linked to using the vehicle. Contractual disputes, with a garage, a body shop or a seller. And third-party insolvency, when the person ordered to pay simply does not.

That is the sales pitch. The policy then splits each block into sub-limits.

Take an ordinary crash: a driver ignores your right of way, their insurer disputes liability, the case goes to the police court. Your legal protection pays the lawyer and the expert, up to the limit. Without it, your own motor liability insurer has no reason to fund a lawyer to claim your damage: its job is to defend your liability, not to assert your rights. That is the whole difference between the defence built into motor liability and genuine legal expenses cover.

The assessment side deserves a mention. AG's offer explicitly covers challenging an assessor's report, which helps the day the other insurer's expert undervalues your car. And the code of conduct for legal protection insurers published by Assuralia, the Belgian insurers' federation, requires the policy to state your right to choose your own expert when the nature of the dispute calls for it.

The intervention threshold: €148.74, a legacy of the Belgian franc

The figure looks arbitrary. It is not: €148.74 is exactly 6,000 Belgian francs converted at the fixed rate of 40.3399. Belfius Direct Assurances' October 2024 sheet still uses it as the minimum amount in dispute and as the threshold below which civil recovery against a third party is not covered.

For an everyday dispute, the threshold does not bite. A mirror torn off for €380 clears it easily. It becomes decisive on the small cases you would still like someone to handle: a rim scraped by an identified driver, a disputed cleaning bill.

Ethias' household policy works differently, and it is tougher on small disputes. It pays no proceedings costs if less than €500 is at stake, and it keeps a €250 excess that disappears if you agree to mediation or conciliation. On a €1,200 dispute with a garage, you therefore keep €250 to pay if you refuse mediation, nothing if you accept it. The clause pushes towards settlement, and says so.

What happens if the person at fault is insolvent?

This is the line nobody reads, and the one that varies most. You win your case, the court orders the person at fault to pay, and they do not: no valid insurance, no income that can be seized. Third-party insolvency cover then steps in, up to an amount set in the policy.

The gaps are considerable. Belfius Direct Assurances caps this cover at €6,250. Ethias, in its household policy, at €25,000. AG pays 100% of material damage and up to €15,000 for other losses.

Let us run a realistic case: an uninsured cyclist hits your parked car, the damage comes to €7,800, you have no omnium (Belgian own-damage cover). With €6,250 of insolvency cover, you are €1,550 short. With cover for 100% of material damage, you are short of nothing. Same cover name, same claim, two outcomes.

The Belgian Common Guarantee Fund only steps in for specific cases, notably when the motor vehicle at fault was uninsured or remains unidentified. For an insolvent cyclist or pedestrian, it normally does not take over.

Not necessarily, and it is the most expensive misunderstanding I come across.

The information sheet of Ethias' Aide Juridique, a sound policy in other respects, excludes in so many words "disputes that fall under compulsory motor liability insurance" and claims with no link to your main or second home. A policy of this kind covers neighbours, employment, inheritance or a bad purchase very well. Road traffic is a separate field there, sometimes excluded, sometimes limited, sometimes available as an option.

Before unticking the car option because "the household policy already covers it", open the household policy's general terms and search for three words: "vehicle", "traffic", "motor liability". Whether they sit under covers or under exclusions gives you the answer in two minutes.

Seven exclusions that recur from one policy to the next

I do not recommend any policy without reading its exclusions. In legal protection they look alike across insurers, with wording that varies just enough to catch you out:

  • costs incurred before reporting: AG's offer does not pay fees incurred before you asked the insurer to step in, except in justified emergencies, so a lawyer you consult on your own the day after the crash may stay at your expense;
  • fines, surcharges and criminal settlements, excluded everywhere, since the cover pays for your defence and never for the penalty;
  • a vehicle rented out: AG excludes claims arising while the car is rented out, worth checking if you rent your car to other private individuals;
  • intentional loss, always excluded;
  • racing, riots, strikes and collective violence, which the Belfius sheet lists explicitly;
  • disputes below the threshold or minimum amount at stake, from €148.74 to €500 depending on the policy;
  • disputes arising during the waiting period, or already known when you took out cover: you cannot insure a fire that is already burning.

The first point is by far the most common in practice. Report first, choose your lawyer afterwards.

Few drivers know this before they win. Once the case is won, the judge normally orders the losing party to pay you a legal costs award (indemnité de procédure), a flat-rate contribution to your lawyer's fees.

If your legal protection paid the lawyer, that sum goes entirely to the insurer, says Assuralia's code of conduct, unless the cover limit is exceeded: it then first pays off the costs left for you to bear.

One more reason to check the limit.

What if the insurer refuses to go to court?

You are not without options. Three mechanisms protect you, and a serious policy spells them out.

The first is free choice of lawyer, guaranteed by the Belgian Insurance Act of 4 April 2014 as soon as judicial or administrative proceedings begin, or in case of a conflict of interest with the insurer. The second is the so-called objectivity clause: if you disagree on how the claim should be handled, you may consult a lawyer of your choice. If they back you, the insurer follows; if they back the insurer, half the cost of that consultation is normally refunded to you. The third comes from Assuralia's code of conduct: a refusal to pay for a lawyer must be sent to you in writing, with reasons, within 14 days of the request.

Car policy add-on or separate policy: the difference shows when you cancel

The add-on to the car policy is easy to manage: one premium, one renewal date, one contact. Yet it follows the fate of the main contract. Switching car insurer also means switching legal protection, with a possible new waiting period on contractual disputes.

A separate policy lives its own life. AG's offer is a one-year contract with tacit renewal, which can be cancelled at least two months before the renewal date for contracts taken out or renewed since 1 October 2024, and at any time from the second year, with two months' notice. One detail is reassuring when switching: under Assuralia's code of conduct, if two successive policies define a claim in a way that leaves you between the two, your current insurer undertakes to cover you up to the lower of the two amounts, provided you were covered without interruption and did not know about the dispute when you signed.

As for management, regulation normally requires legal protection to be kept separate from the rest of the insurer's business, hence specialist entities such as Providis at AG. The channel you buy through, broker, tied agent or direct insurer, also matters on the day of the dispute: see direct insurer or broker.

Ten minutes to read your cover

Open your specific conditions, then the legal protection general terms. In this order:

  1. Check that the cover is actually in place. The words "legal protection" must appear in your specific conditions, with their own premium, which the insurer must show separately on the renewal notice.
  2. Note the overall limit, then the sub-limits per cover: criminal defence, contractual claims, insolvency.
  3. Find the intervention threshold and the excess, and any mediation condition that removes it.
  4. Note the waiting periods, especially for contractual disputes.
  5. Read the clause on costs incurred before reporting.
  6. Look for free choice of lawyer and the objectivity clause. If they are not stated explicitly, treat it as a warning sign.
  7. If you have a household policy, search its exclusions for "vehicle" and "traffic".
